The American With Disabilities Act of 1990 - ADAAA - as amended, prohibits covered entities from discriminating in the public or private sector against a disabled person or a person regarded as having a disability. Specifically, a covered entity may not:

  • Discriminate against a qualified person with a disability ;
  • Retaliate because the person complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit;
  • Fail to provide reasonable accommodation for a disabled person; and
  • Harass an individual because of the individual's disability.

The EEOC is the agency that has enforcement authority for this regulation and they have significantly increased the number of disability discrimination claims against covered entities. It is therefore important that employers audit their current practices to ensure that there are no gaps that could result in penalties for non-compliance.
